TERMS AND CONDITIONS OF SALE

These Terms and Conditions of Sale (T&Cs) apply to all orders placed on the Trist'Art's Toys website.

Any order implies full and unconditional acceptance of these T&Cs.


1. Products

The products offered for sale are figurines, art toys, collectibles, and artistic creations.

Products are described as accurately as possible.
Photographs are non-contractual.

Some products may be produced in small batches, limited editions, or made to order.


2. Prices

Prices are indicated in euros (€).

In accordance with the micro-enterprise regime:
VAT not applicable, Article 293 B of the French Tax Code.

Shipping costs are not included in the price and are indicated before order validation.

The seller reserves the right to modify prices at any time, but the applicable price is the one displayed at the time of the order.


3. Orders

An order is validated once payment has been accepted.

The seller reserves the right to refuse an order in the event of:

  • a dispute with the customer
  • an obvious pricing error
  • a payment issue
  • an incorrect address

A confirmation email is sent after validation.


4. Payment

Payment is due immediately.

Accepted payment methods are those offered on Shopify, including:

  • Credit/Debit card
  • PayPal
  • Other methods offered by Shopify

The order will only be shipped after payment has been received.


5. Shipping

Products are shipped from France.

Shipping is available to most countries worldwide, subject to legal, logistical, or carrier restrictions.

Delivery times are provided for information purposes only.

The seller cannot be held responsible for delays caused by:

  • the carrier
  • customs
  • exceptional circumstances

Customs duties and any applicable taxes are the responsibility of the customer.

6. Right of Withdrawal

In accordance with Article L221-18 of the French Consumer Code, the customer has a period of 14 days from receipt of the product to exercise their right of withdrawal.

In accordance with Article L221-28 of the French Consumer Code, this right does not apply to personalized products, made-to-order items, limited editions, or small-batch productions when their nature does not allow for standard returns.

The period begins upon receipt of the product.

The product must be returned in its original condition.

Return shipping costs are the responsibility of the customer unless the seller is at fault.

Certain products may be excluded from the right of withdrawal, including:

  • personalized products
  • made-to-order products
  • limited editions produced on demand

7. Damaged or Non-Compliant Products

The customer must check the package upon receipt.

In case of an issue, the customer must contact the seller within a reasonable timeframe.

Proof may be required (photos, description, etc.).

Depending on the situation, the seller will offer:

  • replacement
  • refund
  • commercial solution

8. Liability

The seller cannot be held responsible for damages resulting from:

  • improper use
  • modification of the product
  • non-compliant use

The seller cannot be held responsible for shipping delays.


9. Intellectual Property

All products, designs, images, 3D models, logos, and content are the property of Tristan Audrain.

Any reproduction is prohibited without prior authorization.


10. Personal Data

Personal data is processed in accordance with the Privacy Policy.

The customer has the right to access, modify, and delete their data.

11. Governing Law

These Terms and Conditions are governed by French law.

In the event of a dispute, an amicable solution will be sought first.

Failing that, French courts shall have jurisdiction.


12. Mediation

In accordance with the French Consumer Code, the customer may refer to a mediator.
